Before diving into the laws enacted in North Carolina, it is important to have a little background information. CBD is a cannabinoid compound that is found in the hemp plant. This plant, known formally as cannabis sativa L., is being grown across the nation in accordance with federal law.
This plant comes in many varieties; and while some states allow for the cultivation of all varieties of hemp, federal law only allows for the growth of industrial hemp. North Carolina Hemp Legislation
North Carolina CBD law first came into existence in 2006. Senate Bill 1572 was presented in May of that year in order to allow NC citizens to “study [the] beneficial uses of industrial hemp.” While this bill was not signed into law on its own, it was eventually incorporated into the 5th edition of House Bill 1723. This HB 1723 was signed by Governor Mike Easley in August of 2006. Even though this research was initiated, the CBD North Carolina shops now offer would not be allowed on shelves until several years later.
In 2014, Barack Obama signed a national Agricultural Act that allowed states to cultivate industrial hemp. This was the federal law mentioned above. Many state legislatures, including North Carolina, took advantage of this opportunity to create industrial hemp cultivation and research programs. The CBD North Carolina residents were looking for became available to certain residents in July of 2015, with the enactment of House Bill 766.
In October of the same year, Senate Bill 313 was signed into law. SB 313 recognized the value of expanding the cultivation and availability of industrial hemp, and also encouraged the expansion of the entire agricultural scene in North Carolina. SB 771 was signed by Governor Pat McCrory in July of 2016. This piece of legislation finalized the details of North Carolina’s industrial hemp program and allowed for the wide availability of CBD products throughout the state.
